Four-year-old Marc Bookal went missing after his mother, Christina Bookal, left him in the care of her boyfriend, Cory Byrd, in mid-December. Byrd told police that Marc walked out the front door of the apartment as the two were getting ready to leave and meet with relatives.
Byrd was subsequently arrested and charged with endangering the welfare of a child. On Tuesday, the prosecution in the case announced they were dropping the charge against Byrd. Nonetheless, according to the Poughkeepsie Journal, Byrd remains a person of interest in Marc’s disappearance.
CITY OF NEWBURGH - A City Court judge ordered prosecutors to let Cory Byrd and his attorney see certain evidence they’ve collected while investigating the disappearance of 4-year-old Marc Bookal.
Byrd’s attorney, Gary Greenwald, has argued his client had the right to know what prosecutors had so that he could defend himself against a charge of endangering the welfare of a child. Judge B. Harold Ramsey agreed, ordering the Orange County District Attorney to turn over the info by Feb. 9.
The order does not entitle Byrd to everything, however. Ramsey’s instructions are tailored directly to the misdemeanor endangering charge. That means evidence collected or search warrants that would pertain to more serious charges – should prosecutors ever file them – can remain confidential. Prosecutors had previously balked at turning over any of what Greenwald requested, saying the case was under consideration for Grand Jury.

I think that guy did something to the baby the same day...hours before he was even reported missing. He may have killed him, hid his body (I hope they check in the woods area by South High School (its near Mark's house). Then he may have thrown his clothes in the river to hide evidence...maybe that's why police dogs picked up his scent by the Huson. Seems possible if suspect would've tried to throw off the police. I watched many crime shows and it just makes sense. I pray so much that they find him alive but if not...give whomever responsible the electric chair!
CITY OF NEWBURGH — Cory Byrd's lawyer pressed a demand to see the evidence against his client in City Court Friday morning.
But the Orange County District Attorney's Office is opposing that request. They're also considering whether to take the case to a grand jury.
Byrd was in charge of Marc Anthony Bookal when the 4-year-old boy disappeared from his Benkard Avenue home a month ago. Byrd is the boyfriend of Christina Bookal, Marc's mother.
Byrd has neither been charged nor named as a suspect in the disappearance, but he was charged with endangering the welfare of a child, a misdemeanor, and violation of parole. But those charges were not discussed in court Friday. Instead, the focus was on a document known as a "demand to produce" filed by Byrd's lawyer, Gary Greenwald.
The document lists more than 31 items, including search warrants, results of urine samples, even a copy of the arrest report.
The search for 4-year-old Marc Bookal yielded no results on Saturday.
City police resumed their search for the missing boy Friday after they received new tips. That effort continued Saturday with help from state police and volunteer search dogs.
CITY OF NEWBURGH — Police will hit the streets again Saturday as they continue pursuing a new lead in the disappearance of Marc Anthony Bookal.
The ground search for the missing 4-year-old boy resumed Friday, only four days after city police declared it was over. By day's end, the search had turned up nothing new.
City police spokesman Lt. Charles Broe said investigators "developed new information" that prompted the reopening of the search.
He wouldn't say what that new information was, but on Friday it led a team of city and state police, including one trooper with a K-9 partner, to the block where Bookal lives, and where he was last seen.
Police searched in vacant buildings and backyards in the block bounded by Liberty, Renwick and South Lander streets and Benkard Avenue.
Newburgh City police officials have called off the ground search for a 4-year-old Marc Bookal.
"The detectives from my agency and the investigators from the state police have been actively working the case from day one, and continue to do so,"
Lt. Charles Broe Sr said Sunday in an e-mail. "Once we covered the entire southeast area of the city, and the river on multiple days, we concluded the ground search part of the investigation. This is not anything new, or anything to do with the weather."
Police divers had searched a stretch of the Hudson River where a police dog caught the boy's scent soon after his disappearance. Foot searches were also conducted, but the child's whereabouts remain a mystery.
The child went missing while under the care of his mother's 30-year-old boyfriend, Cory Byrd. at their home on Benkard Avenue. Byrd has been charged with endangering the welfare of a child in connection with the disappearance. He also was charged with violating parole. He was on parole for a prior conviction on felony counts of assault and criminal sale of a controlled substance, according to information from the state Department of Correctional Services.
Marc was last seen wearing a red long-sleeved shirt, white Nike sneakers and gray sweatpants. He has a medium-length Afro hairstyle and skin discolorations from a previous burn injury.
Marc Bookal, age 4, disappeared sometime around December 14 after walking out of his mother’s home in Newburgh, New York. Two weeks later and authorities still have no idea where Marc is.
SCUBA diving in the Hudson River was suspended after two days, but detectives and State Police are are still investigating other areas of the case.
When asked to take polygraph tests, the boys natural parents agreed, but the mother’s boyfriend refused. Cory Byrd is charged with endangering the welfare of a child. Byrd was the last one seen with Marc.
